Terms of Purchase

Course Access and Inclusions
These Terms of Purchase apply to purchases of Ambient Content System (“the Course”), provided by Ben Shipp, trading as Focus Soundscapes (“we”, “us”, “our” or “I”).
By purchasing the Course, you confirm that you have read and agreed to these terms.
Your purchase includes access to:
Ambient Content System video course
The downloadable materials described on the sales page
Any included templates, stems, overlays or project assets
The private student Discord community, while it remains available
Any other inclusions specifically listed on the sales page at the time of purchase
Course access is provided through Payhip. You are responsible for maintaining access to the email address and Payhip account used for your purchase. Your access is personal and may not be transferred to another person
Payments
Prices are displayed in USD unless otherwise stated. Payment is processed through Payhip and its supported third-party payment processors.
You are responsible for any currency-conversion charges or other fees applied by your bank or payment provider.
If payment is reversed, refunded, disputed or remains unpaid, access to the Course, downloadable materials and student community may be suspended or removed.
Software and Equipment Requirements
The Course demonstrates workflows involving third-party software, plugins and services. These may include paid applications, subscriptions and separately licensed software.
Unless expressly stated otherwise, your purchase does not include:
Third-party software or plugins
Software subscriptions
Computer hardware
Internet access
Accounts with third-party platforms
You are responsible for reviewing the system and software requirements disclosed on the sales page before purchasing.
The Course will still provide educational value if you use alternative software, but identical functionality or results cannot be guaranteed.
Refund Policy
You may request a refund within seven calendar days of your original purchase though the home page contact form on focussoundscapes.com
Your form request and/or message must include the terms “ACS” and “refund” along with your order details.
Refund requests submitted after the seven day period will generally not be accepted for change of mind. We may consider exceptional circumstances at our discretion.
If a refund is issued:
Your Payhip course access will be revoked
Your access to downloadable materials will end
Your access to the student Discord community will be removed
You must cease using and delete any downloaded Course materials
Nothing in these terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded, including rights available under the Australian Consumer Law. Where the Course has a major problem, is materially different from its description or cannot be supplied as promised, you may be entitled to a remedy regardless of the seven-day change-of-mind period.
Intellectual Property and Permitted Use
The Course and its contents are owned by or licensed to Focus Soundscapes and are protected by applicable intellectual-property laws.
Your purchase grants you a limited, personal, non-exclusive and non-transferable licence to access the Course and use the supplied materials in accordance with these terms.
You may:
Use the Course for your own education
Use included assets within your own finished creative projects, where the applicable asset licence permits it
Modify permitted assets as part of your own finished content
You may not:
Share your login or course access
Upload, copy or redistribute Course videos
Resell, sublicense or distribute Course materials
Offer the supplied assets as standalone downloads
Upload the materials to file-sharing websites
Republish the teaching material as your own course or training product
Share the private Discord invitation with non-students
Any supplied third-party materials remain subject to their original licence terms.
Third Party Platforms
The Course discusses or uses third-party products and platforms. Focus Soundscapes & Ambient Content System do not control these third parties and are not responsible for changes to their:
Pricing
Features
System requirements
Terms or policies
Availability
Interfaces or workflows
References to third-party products do not imply ownership of or responsibility for those products.
Course Updates and Availability
We may update, replace or reorganise Course lessons and materials to improve the Course or reflect changes in relevant software and platforms.
We will take reasonable steps to maintain access for the period advertised at the time of purchase. Temporary interruptions may occur because of maintenance, technical problems or third-party service outages.
Course access is sold as lifetime however hosting methods may change over time and you will be required to follow the steps provided to retain access. This may include viewing and downloading Course content on alternate platforms.
Suspension and Termination
We may suspend or terminate access where we reasonably believe that a customer has:
Shared or resold Course access
Redistributed protected materials
Engaged in fraud or payment abuse
Seriously or repeatedly breached these terms
Used the Course or community unlawfully
Where reasonably possible, we will notify the customer and provide an opportunity to address the issue before terminating access, except in cases involving fraud, unlawful conduct or serious harm.
Liability
To the maximum extent permitted by law, we are not responsible for indirect or consequential losses arising from decisions made using the Course, third-party platform changes, business performance or a failure to meet a student’s personal expectations.
Nothing in these terms excludes or limits liability or consumer rights where doing so would be unlawful.
Governing Law
These terms are governed by the laws of New South Wales, Australia.
Nothing in this section limits any mandatory consumer protections that may apply in a customer’s country or jurisdiction.
Changes to Terms of Purchase
We may update these terms from time to time. The terms applying to your purchase will generally be those published when you completed your purchase, except where a change is required by law or is more favourable to you.
